BOOKING TERMS AND CONDITIONS

PLEASE READ THESE BOOKING TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS SITE AND/OR PROCEEDING WITH ANY BOOKING.

THIS IS A BINDING LEGAL AGREEMENT BETWEEN YOU AND US.

BY PLACING A BOOKING, YOU AGREE TO AND ACCEPT EACH AND EVERY ONE OF THESE TERMS AND CONDITIONS. PLEASE DO NOT PROCEED WITH A BOOKING IF YOU DO NOT AGREE TO EACH AND EVERY ONE OF THESE TERMS AND CONDITIONS.

WE RESERVE THE RIGHT TO AMEND THESE TERMS AND CONDITIONS AT ANY TIME AND YOU SHOULD THEREFORE CHECK THEM EACH TIME YOU MAKE A BOOKING. THE TERMS AND CONDITIONS APPLYING TO YOUR RESERVATION WILL BE THOSE IN PLACE ON THE DATE THAT YOU MAKE YOUR BOOKING HOWEVER WE MAY UPDATE CERTAIN ELEMENTS OF THESE TERMS AFTER YOUR BOOKING IN ACCORDANCE WITH PARAGRAPH 23.2 BELOW.

 

  1. Definitions and interpretation

In these Booking Terms and Conditions, the following words shall have the following meaning:

“We” “Our” or “us” means Vertus Edit whose registered office is at [One Canada Square, Canary Wharf, London, United Kingdom, E14 5AB] or other or any of the Vertus group of companies owned by Canary Wharf Group plc;

“Booker”, “you”, or “your” means the person making the booking and/or staying at Vertus Edit;

“Additional Charges” has the meaning given in paragraph 8;

“Charges” means the room rates for your hire of the Studio as further set out in paragraph 7 below;

“Group” or “Group Booking” means a booking of 10 or more Studios (whether as one single booking or as a group of bookings made by you or any of your Guests for the same or any overlapping period of time) at Vertus Edit;

“Group Bookings Terms and Conditions” means the terms and conditions relating to Groups and to Group Booking(s), set out at paragraphs 4 and 24 below;

“Guest(s)” means the guests, including the Booker, who have been invited to stay at our accommodation as set out in the relevant booking;

“Guest Terms” means the conditions and rules applicable to all Guests (including the Booker) as set out at paragraph 18;

“Offline” means a booking/enquiry made with Vertus Edit, via telephone, live chat or via email;

“Online” means a booking/enquiry made with Vertus Edit via our website;

Privacy Policy” means our privacy and data protection policy made available on our website and updated from time to time on notice;

Serious Breach”. A Serious Breach includes any failure to make payments and also:

  1. Any breach of the Terms, which breaches, or in our reasonable opinion will breach, any law or regulatory requirement, poses a health, safety or fire risk or which otherwise jeopardises any of Our operating licenses;
  2. You or a Guest demanding that we do anything that we cannot or should not do (due to such action breaching any law or regulatory requirement, posing a health, safety or fire risk or otherwise jeopardising any operating licenses), or you or a Guest otherwise demanding that we permit them do anything that breaches any law or regulatory requirement, poses a health, safety or fire risk or otherwise jeopardises any operating licenses, after you have been informed them that it is not permitted; and
  3. You or any Guest engages in any unacceptable conduct, including but not limited to:

i) Any threatening, abusive or derogatory behaviour towards staff (which includes verbal and written abuse, comments and remarks) or conduct intended, or which is likely, to have the effect of damaging Our reputation;

ii) Failing to promptly provide information reasonably required by us to perform our obligations in contract to you and your Guests.

Studio” is the default accommodation unit bookable at Vertus Edit.

“Terms” means these Booking Terms and Conditions and such other terms as are incorporated under paragraph 12 below, as the same may each be updated or replaced from time to time;

 

Unexpected Events” means any acts, events, omissions or accidents beyond your or our reasonable control and includes:

  1. acts of God (flood, drought, earthquake, other natural disaster, severe weather warning or adverse weather event;
  2. collapse of buildings, fire, explosion or accident;
  3. burglary or malicious acts of third parties;
  4. epidemic or pandemic (this includes but is not limited to COVID-19), in each case including, but not limited to, any actions, recommendation, announcements or restrictions, related to its subject matter (whether made by a government body, authority, public heath organisation or other similar body) or outbreak at the accommodation where the restrictions are applicable fewer than 4 weeks from the date of your booking;
  5. Terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations;
  6. Nuclear, chemical or biological contamination, or sonic boom;
  7. industrial disputes (whether involving our workforce or any other);
  8. Any law or any action taken by a government or public authority, including without limitation imposing an export or import restriction, quote or prohibition; and
  9. Interruption or failure of utility service.

 

“Visitors” means any person who visits a Guest at Vertus Edit; and

Website Terms and Conditions” means the terms and conditions for use of our website, as the same may be updated from time to time on notice, and which are available at [web address].

2.            Basis of this Agreement

2.1          In consideration of your payment of the Charges (and any Additional Charges as may be applicable) and your performance your obligations under these Terms we shall make available to you a Studio (or Studio(s)) at Vertus Edit for hire by you and your Guests on a non-exclusive basis, subject to and on the terms of these Terms.

2.2          All bookings are strictly subject to acceptance of these Terms If you do not accept these Terms, you must not place your booking. To complete your booking, you will be required to, and are deemed to, accept these Terms. .

2.3          Upon completing your booking and receiving your confirmation you enter into a binding contract with Vertus Edit on these Terms (subject to paragraph 23) for your stay. We reserve the right to refuse any booking at any time prior to our issuing a confirmation and otherwise to cancel any booking in the other circumstances set out in these Terms.

3.            Your Booking

3. 1) You can place a booking Online or Offline. You will be required to provide the name, email and telephone number of the Booker and/or at least one lead Guest. You will have the opportunity to verify and correct any information relating to your booking at each stage, before confirming the booking.

3. 2) Any booking made will only come into existence when payment of the Charges (and any Additional Charges notified in advance) has been made in full (or, in the event of flexible bookings, once the payment card has been validated) and your booking confirmation has been dispatched by We may from time to time agree that you do not need to make payment in full upfront, in which case the booking will come into existence upon dispatch of the booking confirmation by us. If you do not need to pay in full, this will be confirmed at the time of booking and the times for payment will be outlined.

3.3) Restrictions may apply but not limited to, minimum night stay and age restrictions. You will be advised of these at the time of booking where applicable.

3.4) As soon as your confirmation and/or invoice are received, please check the details carefully. If anything is not correct let us know immediately. We regret we cannot accept any liability for any inaccuracy in the documentation save where caused by our, or our agents’ negligence or other default.

3.5) If you are aware of any inaccuracy or error in a confirmation and/or invoice, please notify us as soon as possible. If there is an error in the confirmation or invoice, we reserve the right but not the obligation to correct it as soon as we become aware of it.

3.6) Minor changes to the booking as a consequence of any error or inaccuracy not caused by Us may be subject to payment of an additional administration fee. See paragraph 9 below.

3.7) Upon check-in, we may require You or your other Guests to

  • show the credit/debit card used to pay for the booking; and
  • a valid photo ID, such as a passport or driving license, in order to verify your booking.

4.            Group Bookings

4. 1) Any Group Bookings will be subject to the Group Booking Terms and Conditions. In particular, the cancellation terms and payment terms differ for Group Bookings. Group Bookings must be made Offline.

4. 2) We will only accept Online bookings for bookings of up to 9 apartments and are entitled to cancel any Online bookings where we become aware they are being used by You or any of Your Guests to avoid the requirement for an Offline Group Booking. In those circumstances, paragraph 9 will apply to the cancellation.

5.            No Cooling Off Period

You acknowledge that the statutory ‘cooling off period’ provided for in the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 does not apply to your booking as it is a contract for the supply of accommodation on a specific date for a specific period.

6.            Special Requests

6.1) We will endeavour to do everything we can to help Guests with special requirements. Please ensure we are made aware in writing, of any special requirements at time of booking so we can help you select the most suitable apartment for your needs.

6.2) Although we will endeavour to meet any reasonable requests no guarantees can be given that any request will be Conditional bookings cannot be accepted, i.e. any booking which is specified to be conditional on the fulfilment of a particular request.

7.            Charges and Payment

7.1) The prices for your booking(s) (the Charges) will be provided on our website for Online bookings and shall be provided to you by a reservations team member for Offline bookings either verbally or in

7.2) All Charges are subject to change and we adopt dynamic pricing. The price stated for a booking is only valid at the time a booking is made . Once a booking has been confirmed, the rate which has been quoted will not be changed:

  • unless you amend or modify the booking; or
  • our cost of supplying the accommodation changes as a result of any increase in taxation beyond our reasonable

7.3) VAT and any other applicable taxes are charged at the rate in force on the earliest of the date of payment, the date of arrival or the date of invoice, unless the VAT rate changes during your If the VAT rate changes during the dates of your stay, VAT is charged at the VAT rate in force on each day of your stay.

 

7.4) Payment in full is required at the time of booking unless otherwise If payment does not reach us at the required time we reserve the right to suspend or cancel any booking made and the amounts set out in paragraph 9 may then be due from You.

7.5) Late payments of any amounts owed by you to us will result in interest being charged at a rate of 2% above Bank of England base rate for the period concerned.

7.6) Where bookings do not require upfront payment, a pre-authorisation of up to 1% will be charged to the payment card used at the time of booking. This is a temporary charge and no funds will be debited from your account. Payment should be made in the currency identified (usually Pounds Sterling or Euro) by Credit or Debit card. We may pass your debit/credit card details to a third party to process any payments on our behalf. Where bookings are not paid in advance, we may require you to pay a deposit. The deposit will be notified to you at the time of booking.

7.7) Any credits on your account must be used within one year of Credits cannot be exchanged for cash. If any credit is not used within one year, it will expire and you will no longer have the benefit of the credit.

8.            Additional Charges

8.1) You will be liable for any breakages, damage, extra cleaning charges, late checkout, any extras ordered during your stay and/or any additional charges incurred by us as a result of your stay (“Additional Charges”).

8.2) You may be required to pay a security deposit to cover any such costs prior or upon arrival at the Property, or to pay the Additional Charges at the same time as the Charges are paid. If the security deposit is not sufficient to cover the cost or no security deposit is paid, then you authorise us to take payment for such charges from debit/credit card supplied for the security deposit. In the event that payment under a debit/credit card is declined, or no card details are provided, we reserve the right to invoice the Booker or other Guest directly for these charges. Any balance on the security deposit will be refunded.

8.3) As a guide, Additional Charges include, but are not limited to, the following:

8.3.1) Administration fees chargeable for amendments or variations to your booking;

8.3.2) Breakages, loss or damage to the Studio or any of its contents;

8.3.3) Cleaning, specialist treatment charges where more than routine cleaning;

8.3.4) Smoking charge in accordance with paragraph 16.3;

8.3.5) Inventory and condition reports: £50;

8.3.6) Storage of luggage after 23:59 on the day of arrival and/or departure (storage is free until 23.59 pm on the day of arrival and/or departure);

8.3.7) Pet stays;

8.3.8) Other services such as extra cleaning may be available on request.

 

8.4) We may update the amounts of the Additional Charges set out above from time to time and on notice.

8.5) VAT and local taxes are payable on all Additional Charges at prevailing rates.

8.6) Where the Additional Charges are not specified in these conditions, we will charge you the actual cost incurred by us or on our behalf together with any administration costs reasonably incurred by us or on our behalf.

9.            Changes, Extensions and Cancellations by You

Your entitlement to cancel, extend or make other changes to your booking will depend on the reservation type that you selected, as set out below.

Name changes or child age changes will not incur any charges or administration fee.

If you wish to extend a stay please give us as much notice as possible in order to facilitate your request. All extensions are subject to availability and rate change at the then applicable rates. We will notify you as to whether we are able to fulfil your extension request and where notice to extend a stay has been given, we reserve the right to take all additional payments and charges from any credit/debit card used to make the original booking, or an invoice for the extended period will be sent to your billing address and payment must be received prior to the extension commencing

Non-refundable bookings

Non-refundable bookings are offered at a reduced Charge, but this is on a ‘no-cancellation’ and ‘no-amendment’ basis. Accordingly, no extensions or amendments are permitted. No refund will be made in the event of cancellation of a non-refundable booking and you will be charged the full amount of the booking.

Fully Flexible bookings

If you wish to amend any detail of your confirmed booking we will endeavour to make the change, which may result in an increase in the Charges depending on the date and length of stay, however we cannot guarantee that we accommodate any changes requested. All changes of date, location and length of stay are subject to availability and Charges at the then applicable rates. All requests for changes must be made to us in writing. Should any change be rejected, the original booking will be re-instated.

Subject always to the above regarding amendments being subject to availability and rate change at the then applicable rates, fully flexible bookings can be cancelled, or amended (including extended) subject to the following:

In the case of a no show, apartments will be held until 01.00 on the day after the scheduled arrival, at which time your booking will be cancelled and the above cancellation charges will apply.

(ii)  Amendments After Check-in

Once you have checked-in, amendments are not permitted other than to the check- out date. Subject always to the above regarding amendments which extend the check- out date being subject to availability and rate change at the then applicable rates, amendments to the check-out date are subject to the following:

(iii)  Cancellations and Amendments for Property Subject to Length of Stay Restrictions

Where there is a minimum and/or maximum length of stay requirement, changes to the check-in and/or check-out dates of the booking (whether made prior to, at or after check-in) will not be permitted to the extent that such amendment would result in the length of stay requirements being contravened.

Subject always to (i) the restrictions above on amendments that would contravene length of stay requirements cancellations and/or any changes to the booking require not less than 28 days’ notice such that:

 

  1. there will be no charge if the booking is cancelled or amended by 00 on the day that is 28 days prior to the applicable check-in date;
  2. in the event of:
  • a no-show; or
  • a cancellation that is later than 00 on the day that is 28 days prior to check-in of the first day of the booking (but which is prior to check-in),

you will be charged the costs payable under the booking of the first 28 nights of the stay;

c. in the case of an amendment that is later than 00 on the day that is 28 days’ prior to check-in of the first day of the booking (but which is prior to check-in), you will be charged the costs payable for the entire amended stay;

d. in the event, after check-in, of a change to the check-out date such that the revised check-out date is at least 28 days after the date of the amendment, you will be charged the costs of the entire amended stay ;

e. in the event, after check-in, of a change to the check-out date such that the revised check-out date is fewer than 28 days after the date of the amendment, you will be charged the costs payable under the original booking for the 28 nights immediately following the amendment to the check-out date.

 

On the cancellation or termination of Your booking (howsoever caused), we will issue you with an invoice setting out the balance between the payments already made by you and any further amounts that may be due from you (including any Additional Charges). You agree to pay this amount (in cleared funds) within 14 days of the date of the invoice.

10.         Cancellation on Your Fault

10.1       Any cancellation of Your booking under this paragraph 10 will be treated as if you had made an “at will” cancellation or truncation of your stay under paragraph 9 (or under the Group Booking Terms and Conditions, if applicable) and we shall be entitled to charge you on the basis set out in paragraph 9 (or under the Group Booking Conditions) as if such cancellation had occurred.

10.2       Either you or we are entitled to terminate the Agreement immediately on notice if the other party becomes bankrupt or insolvent.

10.3       We may cancel the booking with immediate effect if you or your Guests commit a Serious Breach of these Terms.

10.4       We may also cancel your booking if you make a Group Booking Online in contravention of paragraph 4 of these Terms.

11.         Pre-Estimate of Loss

11.1       The fees and other costs due to us arising from any cancellation or amendment to your booking as set out in these Terms are calculated as a pre-estimate of our losses that directly result from your cancellation or breach of contract, including unavoidable expenses, we will incur and our direct loss of profit (including the value of the booking date and likelihood of us being able to rebook the cancelled booking). You acknowledge and agree that these amounts are a reasonable pre-estimate of our direct losses.

11.2       Where your stay had/has not yet commenced, the total payment made or to be made by you for such room shall be deemed a cancellation charge and is not for any service

12.         Other Terms & Disclaimer

  • Your attention is drawn to:
  • our Website Terms and Conditions;
  • our Privacy Policy;

which are deemed to be incorporated into these Terms.

  • In the event of any inconsistency between any of the above terms and the Booking Terms and Conditions, these Booking Terms and Conditions prevail.
  • Your attention is drawn in particular to the disclaimer regarding the accommodation and our services as set out in the Website Terms and Conditions. In particular:
  • Information on our website is posted in good faith and updated regularly, but we cannot guarantee its completeness and accuracy; and
  • We have made every effort to describe and illustrate the products and services as accurately as possible on the website. Photographs displayed on the website are for illustrative purposes, but details may vary depending on the actual type or category of product or service chosen. In the event of a slight discrepancy between the description of the product or service on the website and the photographs used to illustrate the product or service, the description will prevail.

13.         Changes or Cancellation by us

  • We do not expect to have to make any changes to your booking however occasionally bookings have to be changed or cancelled or errors in information or other details corrected and we reserve the right to do If this does happen, we will contact you by the method of communication specified in your booking. If a change has to be made or your

 

booking has to be cancelled we will, if possible, offer you an alternative accommodation of similar type and standard in a similar location for the same period.

  • If the alternative accommodation is advertised at a lower price, you will receive a refund of the price difference.
  • If the alternative accommodation is at a higher price and cause of this change or cancellation does not arise from our negligence or other fault, the new price will be payable.

If you do not wish to accept a change or any alternative accommodation offered or we cannot offer you a suitable alternative, you shall be entitled to cancel your booking and receive a refund in full. You should tell us as soon as possible whether you wish to accept any change or alternative accommodation offered or alternatively if you want a refund.

  • Save where the relevant changes arise solely from our fault or negligence, we will have no liability for any costs, damages or losses that you incur as a result of any changes or cancellations to your booking and your sole remedy will be a refund of the Charges paid to us
  • From time to time, we may have to restrict the facilities available at Vertus Edit due to essential maintenance or due to any Unexpected Events. Whilst we will use reasonable endeavours to provide the services outlined on our website, we do not guarantee that all facilities and service will be available at all times or unrestricted during your Where the result is that we are unable to substantially provide you with the accommodation and services under your booking, we will notify you as soon as is reasonably practicable and  cancel your booking (or shall do so on your written request). If we cancel your booking, we will issue you with a full refund and your refund will be your sole remedy for the cancellation of your booking. Under no circumstances will we be liable to you for any amount in excess of the amounts paid by you or your representative in relation to your booking.

14.         Force Majeure

  • We are not liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by an Unexpected Event.
  • If an Unexpected Event occurs, We will discuss with You the proposed steps to minimise the impact of the Unexpected Event and the options available.

15.         Liability

This clause sets out our entire financial liability to you and your Guests in respect of:

  • any breach of contract or negligent performance of these Terms;
  • any negligent performance by us (or our employees or contractors) connected with these Terms; and.
  • any representations, statements or negligent or harmful acts or omissions by us arising under or in connection with these Terms.
    • We are not responsible for your personal belongings or the personal belongings of Guests during or after your stay in any Studio, including the theft and/or damage of your (or their) personal belongings. Therefore, you are strongly advised to ensure you have appropriate insurances in place to cover any theft or damage during your stay at Vertus Edit.

    • Nothing in these terms and conditions will affect your statutory rights if you are a consumer. Nothing in these terms and conditions limits or excludes our liability for death or personal injury resulting from negligence, or for any damage or liability incurred by you as a result of fraud or fraudulent misrepresentation by us, or any liability that cannot by law be
    • Where we have been negligent and/or breached a contractual obligation to you, we will be liable for any loss or damage you suffer as a result, as long as the loss or damage is foreseeable as being a result of that breach. Loss or damage is foreseeable if it is an obvious consequence of our negligence or breach of contract, or would have been considered by you and us to be a likely consequence of it at the time the parties entered into these Terms, and for the avoidance of doubt, in case of any liability incurred by us to you under paragraph 13, this shall be limited to any loss that you could not reasonably avoid or mitigate and which arose as a direct result of the change or cancellation.
    • Our liability to you shall be limited to the total charges paid by you in relation to the booking in relation to which the relevant liability arose.

 

16.         Conduct of Guests

16.1       You are responsible for the conduct of your Guests. We expect that each Guest will adhere to the Guest Terms, as set out below and although we will make the Guest Terms available to each Guest (including to you, as applicable):

a)    you agree to indemnify us and to hold us harmless in respect of any damage to or loss of our property whosoever caused during or as a result of you or your Guests’ stay at the accommodation, save to the extent caused by us or an employee or agent of ours; and

b)    you agree to indemnify us and hold us indemnified for any costs incurred by us in full if you or your Guests breach the Guest Terms.

 

17.         Accommodation Use

  • All Studios are only to be used as temporary or holiday accommodation for you, or your organisation. They are not for use as the principal, additional home or residence of guests; you will not be entitled to a tenancy or an assured shorthold or assured tenancy.
  • No relationship of landlord and tenant is created and no statutory security of tenure exists now or when the period of occupation ends. If you or any Guest or other member of your party fails to vacate at the end of the period you will be charged the appropriate accommodation charges for the continued period of occupation. No persons other than the Guests have the right to use the apartment. These conditions constitute an excluded agreement under S(3A)(7)(a)of the Protection from Eviction Act 1977 (as amended) and cannot be construed as an assured tenancy under the Housing Act 1988 (as amended).
  • We cannot guarantee an exact Studio number prior to arrival. The maximum Guests in a Studio is determined by the number of beds in the Studio. If the maximum number is exceeded then we may refuse access to the accommodation and/or reserve the right to charge for additional

18.         Facilities & Services

  • Cleaning: as standard, we will give your Studio a full clean after 7 nights, and weekly for the duration of your stay.
  • Maintenance: Routine maintenance is carried out regularly; however, occasionally we may need access to your Studio to carry out essential maintenance. We will endeavour to give you 24 hours’ notice except in the event of an emergency when we require immediate access.
  • Internet: Guests and their Visitors must not interfere, move or disconnect any equipment relating to the provision of internet access and must not use the connection for any illegal or immoral purpose (including but not limited to file sharing) and We reserve the right to pass on any record to the authorities should Vertus Edit be made aware of any such use. Vertus Edit reserves the right to disconnect a Guest at any time without notice if, in Our opinion they breach any of these Terms.

19.         Guest Terms

  • Guests are expected to comply with any regulations for use of the Studio. These are available on arrival and on our If any guest breaches any of these

 

conditions or the regulations, we reserve the right to request a guest vacate their apartment immediately without refund..

  • Capacity: The number of people in a Studio must not exceed the sleeping capacity of the Studio.
  • Smoking: Smoking is not permitted in any Studio or anywhere inside Vertus Edit, this includes the use of electronic cigarettes. You are responsible for your Visitors not smoking. If you are found to breach this paragraph 13.2, you will be liable to pay us a fee of £240 as a liquidated You will also be required to indemnify us in relation to any fines and/or other fees incurred by us, Vertus Editas a result of your smoking at Vertus Edit.
  • Pets: We are a pet-friendly property and you may bring 1 pet of up to 30 kilos to each Studio. For any pet other than cats and dogs, please inquire in writing to confirm whether we are able to welcome them.
  • Registered service animals will be permitted where notice has been given prior to arrival.
  • Additional charges apply for pets (excluding registered service pets) and a completed pet waiver upon check-in is It is your responsibility before arrival to check that your pet is permitted at Vertus Edit.
  • If You are bringing a pet to stay at the accommodation, You must also adhere to the following rules:
  • You are only permitted to have 1 pet in any room at any given time;
  • You must control any noise made by the pet to ensure it does not disturb other guests at our accommodation;
  • No dog can be left alone in any room or suite at any time unless the dog is crated in a suitable crate provided by You or another Guest;
  • if the dog is to be left alone, it must be suitably ‘crate trained’; and
  • You must pick up any deposits left by any pet immediately.
    • Notwithstanding the above, We reserve the right to refuse to accommodate Your pet at our discretion and may do so reasonably if We consider the pet will present a risk to any Guest, staff, visitors or otherwise to the operation of our services.
    • Nuisance: Guests are required to behave in a responsible manner, respect the Studio and their fellow guests and keep noise to a minimum between the hours of 10pm and 7am. This includes causing any sort of nuisance or disruption to fellow guests or using threatening or abusive behaviour towards a member of staff on the phone, in writing or in
    • Guests are not permitted to use the Studio for any illegal or immoral purposes.
    • Right to Eject: We reserve the right to require, at Our absolute discretion, any Guest or other visitor to leave the accommodation if behaving in a drunk or disorderly manner, or use abusive, violent or threatening behaviour. Depending on the circumstances, this may also be a breach of the Terms and we may be entitled to cancel the booking entirely.
    • Age Restrictions: In order to ensure the safety of all our guests, bookings may not be accepted for any Guests under the age of 18 unless there has been prior agreement in writing directly with Vertus Edit. We require that there is at least one person aged 18 or over travelling with any child and be residing in the same Studio unless by prior agreement. Proof of identification and date of birth may be requested on arrival and if not presented on request, we reserve the right to cancel the booking.
    • Visitors: Guests are responsible for their Non-guests will not be allowed access to the Studio after 11pm and we operate a strict no party policy.
    • Damage: Guests are required to keep the Studio, furniture, fittings and effects in the same condition as on arrival. Inventories and condition reports can be provided at the start and end of the stay, if required, at an additional cost. You are required to notify us of any damage, loss or broken items or matters requiring general maintenance. Any damage to the Studio will be charged in full on a full recovery basis. In the event that these are discovered after departure we will notify you or the Booker (if different) within 7 days of departure with full details and where possible photographic evidence. We reserve the right to charge the card payment details provided and pre-authorised at the time of booking where you or any visitor causes damage of any kind to Vertus Edit.

Cleanliness: We expect the Studios to be left in a reasonable state of cleanliness, repair and order on departure. An additional charge will be made for extra cleaning or specialist cleaning to return the Studio to a fit state for occupation. Additional charges may include compensation for loss of revenue in addition to cleaning and repairs if the Studio is required to be placed out of service due to being left in a poor state of cleanliness and order.

  • Lost Property: All your possessions should be removed from the Studio on the date of departure. If you believe you have left any item behind, you should contact us directly who will advise if they have found your lost Any property left by you shall be at your sole risk.
  • Gym: The use of gym facilities is subject to guests signing a mandatory disclaimer, acknowledging and agreeing to the terms of use of the

20.         Health and safety

We take the health and safety of all our guests seriously. On arrival we strongly suggest you familiarise yourself with the layout of the Studio and Vertus Edit and the health and safety procedures as detailed in your Studio.

21.         Quality and feedback

We are committed to providing quality accommodation and conduct regular audits to ensure that high standards are maintained at the Studios. We also welcome feedback from our guests and ask them to complete a guest satisfaction survey on departure. We value this feedback which provides us with useful information on how we can improve our services further.

22.         Complaints or Enquiries

In the unlikely event that you are dissatisfied with any aspect of your accommodation please notify the general manager/duty manager as soon as possible in the first instance. If you do not give us the opportunity to resolve a problem during your stay, it is impossible to help rectify any issues with your stay. We aim to deliver the best possible customer service, but in the unlikely event that you are dissatisfied with our service, please contact us by email to ask@vertusedit.com.

  1. Privacy, Data Protection and Management
    • At various stages of your website and booking journey we may collect personal data and contact All information collected or properly obtained will be processed in accordance with our Privacy Policy which is available on our website. Telephone calls may also be monitored and/or recorded as a security measure, to help us to train our staff and improve our service to you.
    • By providing information about you and your Guests (as outlined in the Privacy Policy) when making a reservation, you consent (on your behalf and on behalf of each Guest) to such processing and you warrant that all information provided by you is accurate.

 

24.         General

  • We reserve the right from time to time to update these It is your responsibility each time you make a booking to check the Terms that are applicable as at the point of making the booking.
  • We may revise these Terms from time to time after booking with regard to how we accept payment from you and if we need to do so to comply with any relevant laws and regulatory requirements. We will give you with reasonable notice of any changes before they take effect and you can choose to cancel the contract at this point if there is a material disadvantage to you.
  • These Terms and any booking form agreed constitutes the entire agreement between the parties relating to its subject matter. You and we acknowledge that in entering into these Terms and making a booking it does not rely on any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in this agreement.
  • No variation of these Terms shall be effective unless it is in writing and signed by you and us.
  • If any provision or part-provision of this agreement is or becomes invalid, illegal or unenforceable, it shall be deemed deleted, but that shall not affect the validity and enforceability of the rest of this agreement.
  • Except as expressly stated, a person who is not a party to these Terms shall not have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any provision of these Terms.
  • These Terms shall be governed by and construed in accordance with the laws of England and Wales and the courts of England and Wales shall have exclusive jurisdiction in relation to any claim, dispute or difference concerning these conditions and any matter arising from or connected with them, save that:
    • if you are a consumer living in Scotland, you can bring legal proceedings in respect of these Terms in either the Scottish or the English Courts; and
    • if you are a consumer living in Jersey, in which event you can bring legal proceedings in respect of these Terms in either the Royal Court of Jersey or the English Courts.

25.         Groups Bookings – Further Conditions

  • Introduction

This paragraph outlines how Vertus Edit deals with group bookings. This paragraph covers direct group requests to any company email address and covers groups that are booked via Online Travel Agents as well as via the Vertus Edit website. The Vertus Edit booking terms and conditions set out above apply also to group bookings, save where the terms relate to the general terms, payment terms and cancellation terms set out below (in which case this paragraph 24applies). Where there is inconsistency between this paragraph 19 and the remaining terms and conditions set out above, this paragraph 24will take precedence.

 

  • Scope

 

  1. It covers the terms and conditions of booking both transient groups and extended stay groups.
  2. A group booking is defined as 10 rooms or more, booking together for one or more nights, booked by one person (or connected persons). 10 rooms must be booked together on the main nights.
  3. It must be applied to any enquiry related to 10 rooms or more for 6 nights or less (Known as a Transient Group) and 10 rooms or more for 7 nights or more (Known as an Extended Stay Group).
  4. All Group bookings for accommodation and room hire at Vertus Edit are subject to these terms and This includes bookings through a third-party website such as, but not exclusively, Booking.com or Expedia. It includes bookings made through an online agency including Cvent and any Conference and Event agency and any other agent. By making a group booking, the client agrees to these terms.
  5. This also covers all groups (as defined above) that are booked on a Prepay or Non- refundable Rate via the Vertus Edit website or any third-party website. Any cancellation for rooms booked using either of these Rate Types will not be

  1. If there is less than 30 days between the booking and the first date of arrival in the agreement, then the full invoice total shall be due.

  2. Upon signing the contract, the deposit will be non-refundable.
  3. Any amendments need to be confirmed in writing. Amendments include name changes or date changes (provided that the same number of room nights are booked as per the contract, subject to availability).
  4. Any additional room nights will be subject to availability and rate will be subject to change.
  5. There will be a 100% charge for all non-arrivals.

All cancellations and reductions made prior to the first guest arrival will be charged 100% of the total room nights cancelled at the contracted rate.
